At ArtHub, we facilitate connections between sellers and buyers while also selling our own products. Please note that ArtHub is not responsible for any damage to an artist's package caused by shipping companies-services. Our primary goal is to help artists and buyers find each other, and we strive to make this process as seamless and comfortable as possible.
ArtHub is not liable for any damages to art products sold by third-party sellers. However, if ArtHub is selling its own art products, we offer a refund policy. To be eligible for a refund, the art product must be returned within one week of receipt. ArtHub does not accept refunds if the art product is not returned first. As soon as the art product is shipped back and we confirm its return, we will process and send your refund. This policy is in place to prevent fraud and scams, and we appreciate your understanding.
2. Definitions
- "Art Submissions" refers to user-created artwork submitted and displayed on the ART HUB website, available for sale.
- "ART HUB", "we" or "us" refers to ART HUB LLC, a company registered in the US, with its registered office at 1667 Wimberly Road, Apex, zip 27523, US.
- "Seller" refers to the individual or entity selling any Goods.
- "Buyer" refers to the person whose name appears on the Order.

Furthermore, Art Hub does not endorse or make any representations regarding these external sites, nor any information, software, products, or materials found there, or any outcomes from using them.

It is your responsibility to review the terms and conditions and privacy policies of any external websites you visit. Any interactions or transactions with third parties, including advertisers found on the Website, are solely between you and the third party, and you agree that Art Hub is not responsible for any loss or claims arising from such dealings.
6. Goods Handling and Risk of Damage
When the Goods are delivered to the specified address, the risk of any damage to or loss of the Goods transfers to the Buyer.
Despite the transfer of risk upon delivery, the Seller retains ownership of the Goods until all payments owed by the Buyer under the Contract, including the Price and any additional sums due, are fully settled. This applies to any current or future agreements between the Buyer and the Seller.
The transfer of risk does not equate to the transfer of ownership. The Seller will maintain the property rights of the Goods until the Buyer has paid in full. This includes the Price and any other amounts due under the present or any other Contract between the Buyer and the Seller. The Buyer acknowledges that only after complete payment is made will the title and ownership of the Goods transfer from the Seller.
In the event of non-payment, the Seller retains the right to reclaim the Goods, and the Buyer must return them at their expense. The Buyer must also ensure the Goods are kept in good condition and insured against all risks until full payment is received by the Seller.
The Buyer assumes responsibility for any damage or loss once the Goods are delivered, but they do not gain ownership until all financial obligations to the Seller are met. This distinction ensures that the Seller's rights are protected, and the Buyer is aware of their obligations concerning payment and property transfer.
7. Shipping Terms
The designated delivery location for the Goods will be specified in the Order. The default delivery method, unless otherwise agreed, will be regular mail or courier at Arthub's discretion.
The Seller aims to process and dispatch the purchase Order within 7 days of Order Confirmation. The delivery dates provided are estimates only, delivery time is not a fundamental term of the Contract, and the Seller is not liable for any loss, or expenses incurred by the Buyer due to delivery delays, regardless of the cause.
Upon delivery, the Buyer is required to inspect the Goods and, if delivered by courier, sign any necessary proof of delivery or collection acceptance documents. The Buyer's signature on these documents will serve as definitive proof that the quantity of Goods received is as stated and free from visible defects or damage. If the Goods are claimed to be damaged or defective upon delivery, the Buyer must provide a written description of the alleged damage or defect at the time of delivery, signed by or on behalf of the Buyer.
Should the Buyer fail to accept delivery of the Goods without just cause, the Seller is not obligated to refund the Price.
Returns of purchased Goods are not permitted except as outlined in Condition 21.
8. Pricing, Payment Methods, and Currency Choices
All prices listed include any applicable sales taxes in the country of origin of the Goods. However, the Buyer is liable for any additional taxes, such as customs duties, that may apply in the destination territory.
Payment for Orders must be made via credit card or debit card at the time the Order is placed and accepted by the Seller. Full payment is required upfront, at which point the Contract is activated.
Arthub may offer the ability to conduct transactions in multiple currencies, providing the Buyer with the option to select their preferred currency during checkout.
The Buyer agrees that all information provided to the Seller and Arthub for the purpose of the Order and its delivery is accurate. The Buyer also ensures that the payment method used is owned by the Buyer and that there are sufficient funds or credit available to cover the total cost of the Goods ordered. Arthub reserves the right to validate the Buyer's credit card or debit card information before accepting the Order.
Credits towards payment may accumulate but can only be applied at the Seller's sole discretion. Arthub retains the right to limit, invalidate, or refuse the use of credits for any purchase or rental at any time. Additionally, Arthub can modify, invalidate, or terminate the conditions for accumulating credits at its sole discretion.
Discounts and promotions offered by Arthub are subject to availability and can be terminated or amended at any time. The Seller reserves the right to reject any Order if there is an error in pricing, discounts, or promotions. Unless specifically agreed upon by Arthub, discounts and promotions are not cumulative, meaning only one discount or promotion can be applied to a single Order.
The Buyer is responsible for ensuring that all details provided for the Order and its delivery are correct. Any discrepancies or inaccuracies in the information provided by the Buyer may lead to delays or additional charges. Arthub is not responsible for any losses or expenses incurred due to incorrect or incomplete information provided by the Buyer.
By making a purchase, the Buyer agrees to the terms and conditions regarding payment and currency options as outlined by Arthub. This includes accepting the Seller's right to verify payment details and the possibility of changes to credit accumulation and discount policies.
In the event of any dispute regarding pricing, payment, or currency options, the terms and conditions set forth by Arthub will prevail. The Buyer acknowledges and accepts these terms as a condition of completing the transaction with Arthub.
9. Goods Sales and Rentals
Goods are available for sale and rental through the Arthub Website, where Arthub acts as an agent for the Seller unless explicitly stated otherwise. The Terms and Conditions, along with any Special Conditions, govern the Contract between the Buyer and Seller, supplemented by any applicable terms under purchase orders, Rental Agreements, order confirmations, or other relevant documents.
Arthub and the Seller's employees are not authorized to make representations about the Goods unless these representations are confirmed in Writing by the Seller. By entering into a Contract and accepting delivery, the Buyer acknowledges that they are not relying on any representations about the Goods that are not confirmed in this written manner.
These conditions outline the foundational rules and expectations for the transaction, ensuring that all parties are aware of their obligations and the extent of any representations made about the Goods. The Buyer is thus aware that only written confirmations from the Seller are valid regarding the Goods' characteristics or promises, and any verbal or non-written representations are not binding.
10. Order Confirmation and Product Details
The availability of all Goods for sale or rental is contingent on approval by Arthub and the Seller. Both Arthub and the Seller have the right to decline any Order without the obligation to provide a reason. An Order is only considered accepted by the Seller once it has been unconditionally confirmed in the Order Confirmation.
Arthub, in partnership with Sellers, Artists, and Curators, is committed to ongoing product development. As such, Arthub reserves the right to amend the specifications of any Goods without prior notice. Given the bespoke and handcrafted nature of many Goods available on Arthub, the exact dimensions of Goods may vary slightly from piece to piece and may differ from the official dimensions listed on the Arthub website.
These guidelines ensure that Buyers are informed about the potential for slight variations in product specifications due to the unique nature of handcrafted Goods. Additionally, Orders are only binding upon formal acceptance, emphasizing the importance of the unconditional confirmation provided in the Order Confirmation. Buyers should be aware that due to the continuous development and bespoke nature of products, there might be modifications in specifications and slight differences in dimensions. This highlights Arthub's commitment to maintaining high-quality standards while accommodating the unique characteristics of handcrafted items.
11. Reporting Violations

- Your use or access to the Art Hub website and any other ArtHub websites
This obligation to defend and indemnify persists even after the termination of these Terms and Conditions and continues for as long as you use the Art Hub website.
18. Website Adjustments
Art Hub reserves the right, at any time and without prior notice, to modify, suspend, or discontinue the Website (or any part of it) either temporarily or permanently, entirely at its discretion. Art Hub will not be liable to you or any third party for any changes, disruptions, or discontinuation of the Website.
19. Liability Restrictions
Art Hub, along with its affiliates, directors, officers, employees, licensors, distributors, suppliers, agents, resellers, owners, and operators, shall not, under any circumstances, be held accountable for any damages, whether direct, indirect, incidental, special, punitive, or consequential, arising from a variety of situations. You understand and agree that Art Hub is not liable for content generated by users, infringements on copyright, or any misconduct by third parties. Any risks associated with such activities are solely assumed by you.
In the case of purchased goods, the total liability of Art Hub, including its agents, employees, subcontractors, and suppliers, is restricted to the net purchase price of the products or services in question. This limitation encompasses claims related to the fulfillment or failure to fulfill contractual obligations, including but not limited to issues of warranty, negligence, or strict liability.
Art Hub operates the website from within the United States and does not make any guarantees regarding its appropriateness or availability in other regions. If you access the site from outside the United States, you do so at your own risk and are responsible for ensuring compliance with local laws.
20. Disclaimer of Warranties
By using the Art Hub website, you acknowledge and accept the inherent risks associated with its use. Art Hub, along with its affiliates, directors, officers, employees, licensors, distributors, suppliers, agents, resellers, owners, and operators, expressly disclaims any and all warranties, whether explicit or implied, regarding the website and its functionality. Art Hub makes no representations or guarantees about the accuracy, reliability, or completeness of the website's content or any content on external sites linked through the website. Additionally, Art Hub assumes no liability for any errors, inaccuracies, personal injuries, unauthorized access, transmission interruptions, or harmful elements introduced by third parties. Art Hub does not endorse, monitor, or take responsibility for the content of hyperlinked websites or third-party promotions.
Art Hub further emphasizes that any advice or information provided through the website, whether oral or written, does not create any warranties beyond those explicitly outlined in these Terms and Conditions. Users are strongly encouraged to exercise caution and good judgment when navigating the website, just as they would in any business or online transaction.
21. Return and Exchange Policy
Customers may return purchases within 7 days of delivery for an exchange or refund, regardless of the reason, by completing the following:
Send an email to shop@arthub.com within 7 days, including: (a) Invoice Number, (b) Artwork Title, (c) Return Reason, and (d) Preference for exchange or refund.
Follow Art Hub's instructions for returning the items in their original state.
Return items in the original packaging and ensure they are unused.
Art Hub will finalize all exchanges or refunds within 30 days after receiving returned items through mail or our chosen carrier. For items sent internationally, a partial refund may apply, with shipping and handling fees deducted.
To cancel an order, email shop@arthub.com within 24 hours of purchase. Depending on the order status, Art Hub may immediately refund or direct the customer to follow the standard return process.
Art Hub is not liable for any damage that occurs after the order has been received. Returns of items damaged after receipt are not accepted.
22. Rights to Intellectual Property
The content available on the Website, including trademarks, service marks, and logos (collectively referred to as "Marks"), is either owned by Art Hub or licensed to it. These elements are protected by copyright and other intellectual property laws, both in the US and internationally. Additionally, you must not attempt to circumvent, disable, or interfere with any security measures or features of the Website designed to control or limit the use and copying of Content, or that enforce restrictions on how the Website and its Content are used.
23. Termination of Account
Art Hub reserves the right to immediately terminate your account and revoke access to the Website and any related Art Hub services under specific circumstances and without advance notice. Termination can occur for various reasons, including but not limited to:
- Breaches of these Terms and Conditions or any other applicable agreements or guidelines;
- Requests from law enforcement or governmental authorities;
- Your own request for account deletion;
- Changes to or discontinuation of the Website (or any portion of it);

- Extended periods of inactivity;
- Participation in fraudulent or illegal activities;
- Failure to settle any outstanding fees related to the Website or other Art Hub services.
Upon termination, Art Hub may:
- Restrict access to some or all sections of the Website;
- Remove your password and all associated information, files, and materials, including any Content linked to or within your account (or any part thereof);
- Prohibit further use of the Website.
You acknowledge that Art Hub's decisions regarding account termination are final and at its sole discretion. Art Hub will not be liable to you or any third party for any consequences arising from the termination of your account, email address, or access to the Website.
24. User Contributions and Art Submissions
Given the interactive nature of the Website, Art Hub cannot be held accountable for materials posted by users. The opinions, suggestions, comments, and any content shared by users ("User Content") are not endorsed or verified by Art Hub. We do not guarantee the accuracy, reliability, or quality of any User Content available on the Website. By using the Website, you assume all risks associated with User Content, including reliance on its accuracy, completeness, or utility. The responsibility for any issues arising from User Content rests solely with the individual who posted it, and any claims for damages or harm must be directed to that individual.
Art Hub mandates that artists adhere to the submission guidelines and agree to the Terms and Conditions when submitting their works for review ("Art Submissions"). Although Art Hub endeavors to verify the authenticity of all Art Submissions before they are featured or sold on the site, the uploader is responsible for their submissions. Any claims for damages or issues resulting from the sale or availability of such Art Submissions on the Website must be addressed with the individual who submitted the artwork.
25. Copyright Violation
Art Hub requires all users who post Content and artists who submit Art Submissions to strictly follow copyright laws. You are prohibited from uploading, modifying, distributing, or reproducing any Content or Art Submissions that are copyrighted by third parties without obtaining their explicit written permission. Art Hub retains the right to remove any Content or Art Submissions that it believes infringes upon the copyrights of others. Additionally, Art Hub may suspend or terminate the accounts of users suspected of violating copyright laws or breaching these Terms of Service.
If you suspect that your copyrighted work has been unlawfully copied or posted on the Website, please provide a written notice including the following information:
- Identification of the copyrighted work that you believe has been infringed. If multiple works are involved, provide a representative list of those works as they appear on the site.
- Identification of the allegedly infringing material or the specific activity that is believed to be infringing. Include sufficient details to help Art Hub locate the material, such as URLs where the content can be found.
